These Terms of Use ("Terms") govern your access to and use of the website, services, products, communications, and related offerings (collectively, the "Services") of MedReadyMD Inc ("MedReadyMD," "we," "us"), 138 Main St #1009, East Rockaway, NY 11518. Our Privacy Policy, Telehealth Consent, Returns & Cancellations Policy, and SMS Terms are incorporated into these Terms by reference.

By accessing or using the Services, or by clicking "I agree" (or a similar button or checkbox) where presented, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and reside in a jurisdiction where the Services are legally available. By using the Services, you represent and warrant that:

  • You are at least 18 years of age.
  • Information you provide is truthful, accurate, and complete.
  • You will update your information as necessary to maintain its accuracy.
  • You are legally authorized to use the Services.

We reserve the right to suspend or terminate access if we believe information provided is inaccurate or misleading.

2. Nature of the Services; No Medical Care by MedReadyMD

MedReadyMD Inc is a technology and administrative platform. MedReadyMD does not practice medicine or pharmacy, and does not provide medical care, diagnoses, or prescriptions. Medical services available through the platform are provided by independent, state-licensed healthcare providers practicing within a contracted third-party medical network. These providers exercise independent professional judgment and are solely responsible for the care they provide. Medications are dispensed by state-licensed pharmacies within a contracted third-party pharmacy network.

3. No Medical Advice

Content available through the Services is provided for informational purposes only. Website content does not constitute medical advice, diagnosis, treatment recommendations, or a provider-patient relationship. Medical decisions are made solely by licensed healthcare professionals. Never disregard professional medical advice based on information obtained through the Services. In the event of a medical emergency, call 911 or seek immediate emergency medical assistance.

4. Prescription and Treatment Disclaimer

Submission of information does not guarantee a consultation, a diagnosis, a prescription, medication availability, or treatment approval. All treatment decisions are made by licensed healthcare professionals exercising independent medical judgment. Prescriptions are issued only when medically appropriate and legally permitted.

5. Compounded Medications

Some medications available through the Services are compounded by state-licensed compounding pharmacies pursuant to a prescription. Compounded medications are permitted under federal law but are not FDA-approved and are not evaluated by the FDA for safety, effectiveness, or quality. FDA-approved medications containing the same or similar active ingredients may be available; discuss all treatment options with your provider. See our Important Safety Information.

6. Pharmacy Fulfillment

MedReadyMD does not manufacture medications. Prescribed medications are dispensed and shipped by licensed pharmacies operating in accordance with applicable laws and regulations. Medication availability, pricing, shipping times, and pharmacy participation may change without notice.

7. Purchases, Subscriptions, and Auto-Renewal

The Services offer both one-time purchases and recurring subscription plans.

One-time purchases are billed once at checkout and do not renew automatically.

Subscription plans: if you enroll in a subscription, you authorize us to charge your payment method automatically at the interval disclosed at checkout (for example, monthly or quarterly) until you cancel. The amount and billing frequency are displayed before you complete checkout. Your subscription will continue to renew automatically unless you cancel before the next renewal date.

How to cancel: you may cancel your subscription at any time from your account portal, or by emailing support@medreadymd.com. To avoid being charged for a renewal, cancel at least two (2) business days before your next scheduled renewal date. Cancellation stops future renewals; it does not entitle you to a refund of amounts already charged, except as described in our Returns & Cancellations Policy.

Prescription orders: because prescription medications are dispensed for individual patients, they are final sale once shipped, as described in the Returns & Cancellations Policy. A renewal order that has already been reviewed by a provider or entered pharmacy fulfillment cannot be canceled for that cycle.

Price changes: we will notify you in advance of any change to your subscription price, and the change will take effect at your next renewal after notice.

8. Communications and SMS

By creating an account or providing your contact information, you consent to receive transactional communications (such as order, account, and prescription updates) by email and SMS. Marketing communications are optional: consent to marketing texts or emails is not a condition of purchase, and you may opt out at any time (reply STOP to any text, or use the unsubscribe link in any marketing email). 9. User Responsibilities

You agree not to:

  • Provide false information or misrepresent your identity
  • Use another person's account
  • Resell, share, or distribute any medication dispensed to you
  • Attempt unauthorized access to systems or interfere with platform functionality
  • Violate applicable laws or upload malicious code or harmful content

Violation of these Terms may result in immediate termination of access.

10. Intellectual Property

All content, trademarks, logos, graphics, text, software, and functionality are owned by MedReadyMD Inc or its licensors. No content may be copied, reproduced, distributed, modified, or used without prior written consent.

11. Third-Party Services

The Services may contain links to third-party websites and services. We are not responsible for the content, privacy practices, security, or policies of third parties. Use of third-party services is at your own risk.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDREADYMD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED AVAILABILITY.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDREADYMD INC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO MEDREADYMD DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND NOTHING IN THESE TERMS LIMITS THE PROFESSIONAL RESPONSIBILITY OF LICENSED HEALTHCARE PROVIDERS FOR THE MEDICAL SERVICES THEY PROVIDE.

14. Indemnification

You agree to defend, indemnify, and hold harmless MedReadyMD Inc and its affiliates from any claims, damages, liabilities, losses, costs, and expenses arising from your use of the Services, your violation of these Terms, your violation of applicable law, or information you provide through the Services.

15. Arbitration and Class Action Waiver

To the fullest extent permitted by law, any dispute arising from these Terms or the Services shall be resolved through binding arbitration on an individual basis. You waive any right to participate in class actions, class arbitrations, or representative proceedings. You may opt out of this arbitration provision within thirty (30) days of first accepting these Terms by emailing support@medreadymd.com with the subject line "Arbitration Opt-Out" and your name and account email. Nothing in this section limits rights that cannot legally be waived.

16. Governing Law

These Terms shall be governed by and construed under the laws of the State of New York, without regard to conflict of law principles.

17. Changes to These Terms

We may modify these Terms at any time. Updated versions will be posted on this page with a revised Effective Date. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

19. Mobile Messaging and Carrier Terms

No mobile information (including your phone number) collected for SMS or text messaging, and no SMS opt-in or consent, will be shared, sold, rented, or otherwise disclosed to third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties. We may disclose mobile information only to service providers or subcontractors that help us operate our messaging program, and only so they can provide those services to us.

Mobile carriers are not liable for delayed or undelivered messages. Message frequency varies, and message and data rates may apply.

You may opt out of text messages at any time by replying STOP to any message. Reply HELP for help. Our SMS Terms and Privacy Policy are incorporated into these Terms by reference.
