5. HIPAA and Health Information

MedReadyMD Inc is a technology and administrative platform and is generally not itself a HIPAA "covered entity." The independent healthcare providers and pharmacies you interact with through the Services are covered entities under the Health Insurance Portability and Accountability Act ("HIPAA"), and your protected health information ("PHI") held by them is governed by HIPAA and their Notices of Privacy Practices, which are provided to you during intake. Where MedReadyMD handles PHI on behalf of a provider or pharmacy, it does so as a business associate under written agreements, and uses and discloses PHI only as permitted by those agreements and by law.

You have rights with respect to PHI held by your providers, including the right to access and receive a copy of your records, request corrections, and request an accounting of certain disclosures. To exercise these rights, contact support@medreadymd.com and we will route your request to the appropriate provider or pharmacy. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, if you believe your privacy rights have been violated. You will not be retaliated against for filing a complaint.

6. State Privacy Rights

  • Know/Access — request the categories and specific pieces of personal information we have collected about you
  • Delete — request deletion of personal information, subject to legal exceptions (such as medical record retention requirements)
  • Correct — request correction of inaccurate personal information
  • Opt out — opt out of "sales" of personal information, "sharing" for cross-context behavioral advertising, and targeted advertising
  • Consumer health data rights — access, delete, and withdraw consent regarding consumer health data, where applicable
  • Non-discrimination — not receive discriminatory treatment for exercising your rights
  • Appeal — appeal a refusal of your request, where provided by state law

How to exercise your rights (two methods):

We may verify your identity before responding, and we will respond within the time required by applicable law. An authorized agent may submit a request on your behalf with proof of authorization.

7. Marketing Communications

You may receive emails, SMS messages, and other communications related to orders, account activity, prescription updates, product offerings, and promotions. Consent to marketing communications is not a condition of purchase. You may opt out of marketing communications at any time (reply STOP to texts; use the unsubscribe link in emails). Transactional and legally required communications may continue after marketing opt-out. See our SMS Terms.

8. Data Retention

We retain information for as long as necessary to provide the Services, fulfill legal obligations (including medical record retention laws applicable to providers and pharmacies), resolve disputes, and enforce agreements. Retention periods vary depending on the type of information and applicable law.

9. Data Security and Breach Notification

We implement reasonable administrative, technical, and physical safeguards designed to protect information, including encryption of data in transit. No transmission over the internet or electronic storage system can be guaranteed to be completely secure. If a breach of security affecting your personal information occurs, we will notify you and the appropriate regulators as required by applicable federal and state law.
